Our Sales Process

A clear, structured approach to ensure success for both partners and franchisees

Lead Registration

Forward prospective customer details (Name, Contact, Discussion Notes, KYC) to info@employmentexpress.net to register the lead under your name for 1 month.

Customer Verification

When a customer approaches us directly, we verify if they're registered under any Channel Partner. If registered under you, we notify both you and the customer.

Booking Confirmation

A booking is confirmed when we receive 70% payment along with signed MoU/Agreement and supporting documents (PAN, Aadhar Card/entity proof).

Franchisee Setup

Provide all franchisee details for the transaction. Commission/royalty will be paid to you directly - you handle internal settlements with sub-brokers.

Channel Partner Earnings

30% + 2%

of franchise value as commission and royalty

  • 30% Commission of one-time franchisee fees for every successful referral
  • 2% Royalty of the monthly business done by franchisees you referred
  • Separate invoices for commission and royalty payments
  • Payments processed within 15 days of valid invoice receipt
  • All payments subject to applicable tax deductions
  • Refund policy for cancelled agreements (refund within 7 days if franchisee claims refund)

  • Company may discontinue any collateral with immediate notice
  • Must stop using discontinued materials immediately

Brand Usage Rules

  • Prior written permission required for your own marketing
  • Cannot use company name/logo beyond agreement terms
  • Must return all marketing materials upon termination

Representation Guidelines

  • Only use company-approved representations
  • No unauthorized commitments on company's behalf
  • Personally liable for any misrepresentations

Partnership Terms & Conditions

Key legal aspects of our Channel Partner Agreement

Contract Duration & Renewal +

This Agreement comes into force on the Effective Date (date of execution) and remains valid for 36 months. The Agreement can be renewed by mutual understanding between both parties.

Termination Clauses +
  • Mutual Termination: Possible at any time by written agreement
  • Company Termination with Notice: 2 months advance notice without needing to provide reason
  • Immediate Termination for Default: 3 days notice for Channel Partner default on agreement terms
Confidentiality Obligations +

The Channel Partner must maintain strict confidentiality of all agreement terms, franchisee agreement details, sales policies, project information, marketing strategies, advertising plans, business policies and business plans. This obligation continues even after termination of the Agreement.

Relationship Definition +
  • No Employment Relationship: Channel Partner is not an employee
  • Non-Exclusive Agreement: Company may partner with others
  • Independent Contractor: No partnership, joint venture or agency created
  • No Solicitation: Cannot employ company staff during agreement
Indemnification +

The Channel Partner agrees to indemnify and keep indemnified the Company against all actions, claims, demands, disputes, liabilities, losses, costs, charges, expenses or damages resulting from:

  • Any acts or omissions while soliciting business
  • Any misrepresentations made
  • Non-compliance with applicable laws
  • Any third party claims
Force Majeure +

Neither party is liable for failure to perform obligations due to Force Majeure events. The affected party must promptly notify the other and use best efforts to remedy the situation.

Governing Law & Dispute Resolution +
  • Governed by laws of India
  • Disputes referred to common Arbitrator appointed by both parties
  • Arbitration proceedings in Ghaziabad under Arbitration and Conciliation Act, 1996
  • Arbitrator's decision is final and binding
